PWR Europe Website Privacy & Cookies Policy
1. Purpose
PWR Performance Products Pty Ltd (AU), C&R Racing Inc (US), and PWR Europe Ltd (UK) (together and separately, PWR) operate websites at www.pwr.com.au, www.pwrna.com, and www.pwreurope.com (together and separately, PWR Websites), respectively, through which they promote, offer for sale, provide, and sell goods and services (Deliverables).
This policy (Privacy Policy) describes how PWR collects, uses, and discloses your personal information when you visit, use the services of, or make a purchase through, the PWR Websites.
2. Privacy notice
PWR values and respects the privacy of the people with whom we engage during our business undertakings. We are committed to protecting individual’s privacy, including by complying with the:
a. Privacy Act 1988 (Cth) and other applicable privacy laws and regulations in Australia;
b. Privacy Act 1974 and other applicable privacy laws and regulations in the USA;
c. Data Protection Act 2018 and other applicable privacy laws and regulations in the UK,
(together, Privacy Obligations).
In Australia, PWR complies with the Australian Privacy Principles (APPs) contained in the Privacy Act (AU). The APPs govern the way in which we collect, use, disclose, store, secure, and dispose of your Personal Information (see Section 4). A copy of the APPs can be accessed here.
In the USA, PWR adopts the principles of the Privacy Act (US), which establishes a code of fair information practices that govern the collection, maintenance, use, and dissemination of Personal Information. The Privacy Act (US) can be accessed here.
In the UK, PWR adopts the requirements of the General Data Protection Regulation (GDPR). For the purpose of the UK GDPR:
a. the term “Personal Information” in the Privacy Policy is to be read as “Personal Data”; and
b. PWR is considered a “controller” of Personal Information.

The Privacy Policy incorporates the Privacy Obligations and applies to all PWR directors, executives, employees (current and prospective), contractors, suppliers, vendors, customers, clients, volunteers, and members of the public interacting with PWR.
By accessing and using the PWR Websites, you agree to the collection, use, and disclosure of your information as described in the Privacy Policy. If you do not agree to the Privacy Policy, please do not use or access any of the PWR Websites.
We may update the Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on the PWR Websites, update the "Last updated" date, and take any other steps required by applicable law.
3. Your personal information
To provide the Deliverables, we collect, and may have collected over the past 12 months, personal information about you from a variety of sources, as set out below. The information that we collect and use varies depending on how you interact with PWR.
In addition to the specific uses set out below, we may use information we collect about you to communicate with you, provide the Deliverables, comply with any applicable legal obligations, enforce any applicable terms of service, and to protect PWR’s rights, its offerings, and the rights of its users or others.
4. How we collect your personal information
The types of personal information that we obtain about you depends on how you interact with the PWR Websites and access the Deliverables. Personal Information is information that identifies, relates to, describes, or can be associated with you. The following describes the categories and specific types of Personal Information that we collect.
Personal Information that you directly submit to us through the PWR Websites may include:
a. basic contact details including your name, address, phone number, and email address;
b. order information including your name, billing address, shipping address, payment confirmation, email address, and phone number;
c. account information including your username, password, and security questions;
d. shopping information including the items you view, put in your cart, or add to your wish list; and
e. customer support information including the information you choose to include in communications with us, for example, when sending a message through the PWR Websites.
Some Personal Information is considered either Sensitive Information (AU) or a “Special Category” of Personal Information (UK). These types of Personal Information include racial or ethnic origin, political opinions, religious beliefs, philosophical beliefs, trade union membership, genetic data, biometric data for the purposes of uniquely identifying a natural person, data concerning health, or data concerning a natural person’s sex life or sexual orientation. Such information is hereafter referred to as Sensitive Information.
We neither collect nor use Sensitive Information as a matter of course. If we need to collect any Sensitive Information, we will do so only:
a. with your specific, additional, and optional consent (freely given, specific, informed, and via unambiguous indication of your wishes through a clear affirmative action, signifying agreement to the collection and processing thereof);
b. if it is necessary to prevent a serious and imminent threat to life or health; or
c. as otherwise required or authorised by law.
In all such circumstances, PWR takes appropriate measures to protect the security of this information.
Once given, your consent to the collection, use, or disclosure of Sensitive Information can be withdrawn at any time by contacting one of PWR Privacy Officers at:

If you would like us to update or amend your Personal Information, or if you have any questions regarding how we collect, use, store, and disclose your Personal Information, please contact us via the relevant email address or phone number listed above.
Some features of the PWR Websites may require you to directly provide us with certain information about yourself. You may elect not to provide this information, but doing so may prevent you from using or accessing particular features.
We also automatically collect certain information about your interaction with the PWR Websites (Usage Data). To do this, we may use cookies, pixels, and similar technologies (Cookies). Usage Data may include information about how you access and use the PWR Websites and your account, including device information, browser information, information about your network connection, your IP address, and other information regarding your interaction with the PWR Websites.
Finally, we may obtain Personal Information from third parties, including from vendors and service providers who may collect information on our behalf, such as:
a. companies that support the PWR Websites, including Shopify;
b. our payment processors, which collect payment information – including bank account, credit or debit card information, and billing address – to process your payment for the Deliverables and to perform our contract with you; and
c. when you access the PWR Websites or open or click on emails that we send you, we – or third parties with which we work – may automatically collect certain information using online tracking technologies such as web beacons, software developer kits, third-party libraries, and Cookies.
Any information we obtain from third parties will be treated in accordance with the Privacy Policy. PWR is not responsible or liable for the accuracy of the information provided to us by third parties and are not responsible for any third party's policies or practices. 5. How we use your personal information
We use your personal information:
a. to provide you with the Deliverables, including to process your payments, fulfill your orders, send notifications to you, create and maintain your account, arrange for shipping, facilitate returns and exchanges, and to enable you to post reviews;
b. for marketing and promotional purposes, such as to send marketing, advertising, and promotional communications and to show you advertisements for products or services. This may include using your personal information to better tailor our offerings and advertising on the PWR Websites and other websites;
c. to detect, investigate or take action regarding possible fraudulent, illegal or malicious activity. If you choose to use the PWR Websites and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password, or other access details with anyone else. If you believe your account has been compromised, please contact us immediately; and
d. to provide you with customer support and improve our offerings. This helps us to be more responsive to you, to effectively provide goods and services, and to maintain our relationship with you.
We use Cookies on the PWR Websites. You can access specific information from Shopify regarding the Cookies that we use here. We use Cookies to power and improve the PWR Websites and our offerings (including to remember your actions and preferences), run analytics, and better understand users’ interactions with PWR. We may also permit third parties and service providers to use Cookies on the PWR Websites to better tailor our offerings.
Most browsers automatically accept Cookies by default, but you can choose to set your browser to remove or reject Cookies through your browser controls. Please keep in mind that removing or blocking Cookies can negatively impact your user experience and may cause some of features and general functionality of the PWR Websites to work incorrectly or no longer be available. Additionally, blocking Cookies may not completely prevent how we share information with third parties such as our advertising partners.
6. How we disclose Personal Information
In certain circumstances, we may disclose Personal Information to third parties for legitimate purposes, subject to the Privacy Policy. Such circumstances may include disclosing your Personal Information:
a. to vendors or other third parties who perform services on our behalf (e.g., IT management, payment processing, data analytics, customer support, cloud storage, fulfillment, and shipping);
b. to business and marketing partners, including Shopify, to provide services and advertise to you. Our business and marketing partners will use your information in accordance with their respective privacy policies and notices;
c. when you direct, request, or consent to the disclosure of certain information to third parties, such as to ship to you products or through your use of social media widgets or login integrations;
d. to our affiliates, or otherwise within our corporate group, in our legitimate interests to run a successful business; and
e. in connection with a business transaction such as a merger or bankruptcy, to comply with any applicable legal obligations (including to respond to subpoenas, search warrants, and similar requests), to enforce any applicable terms of service, and to protect or defend PWR, the PWR Websites, PWR’s rights, and the rights of our users or others.
In the past 12 months, we may have disclosed the following categories of Personal Information in accordance with the Privacy Policy:
a. identifiers such as basic contact details and certain order and account information;
b. commercial information such as order information, shipping information, and customer support information; and
c. Internet or other similar network activity, such as Usage Data,
including to the following categories recipients:
a. vendors and third parties who perform services on our behalf (such as Internet service providers, payment processors, fulfillment partners, customer support partners, and data analytics providers);
b. business and marketing partners; and
c. Affiliates.
We neither use nor disclose Sensitive Information for the purposes of inferring characteristics about you.
PWR WILL NEVER SELL YOUR PERSONAL INFORMATION OR SENSITIVE INFORMATION.
7. User generated content
The PWR Websites may enable you to post product reviews and other user-generated content. If you choose to submit user generated content to any public area of the PWR Websites, this content will be public and accessible by anyone.
We do not control who will have access to such information and cannot ensure that parties who have access to it will respect your privacy or keep it secure. We are not responsible for the privacy or security of any information that you make publicly available, or for the accuracy, use, or misuse of any information that you disclose or receive from third parties.
8. Third Party Websites and Links
The PWR Websites may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by PWR, you should review their privacy and security policies and other terms and conditions. PWR neither guarantees, nor is responsible for, the privacy or security of such sites, including the accuracy, completeness, or reliability of information found thereon. Information that you provide on public or semi-public venues, including information that you share on third-party social networking platforms may also be viewable by other users of the PWR Websites, and users of those third-party platforms, without limitation as to its use by PWR or a third party. PWR’s inclusion of such links does not by itself imply any endorsement of the content on such platforms or of their owners or operators, except as explicitly disclosed on the PWR Websites.
9. Children's data
The PWR Websites are not intended to be used by children. PWR does not knowingly collect any Personal Information about children. If you are the parent or guardian of a child who has provided us with their Personal Information, you may contact us using the contact details set out above in Section 4 to request that it be deleted. As of the Effective Date of the Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) Personal Information of individuals under 16 years of age.
10. Security and retention of your information
No security measures are perfect or impenetrable, and we cannot guarantee perfect security. Any information that you send to us may not be secure while in transit. PWR recommends that you do not use unsecure channels to communicate sensitive or confidential information.
We are compliant with the global Payment Card Industry Data Security Standard, which is an information security standard for organisations that handle credit card data. This means that when you shop with us, both in-store and online, your credit card details will be handled using secure processes anywhere in the world. Despite this, you should still exercise caution when shopping online and never enter any credit card details when contacting us via email or through our website “Contact Us” form as in these instances, such details will not be protected by encryption.
As a global business, it may be necessary to transfer or disclose your Personal Information overseas in the course of our usual business operations. Some of the third-party service providers to whom we disclose or transfer your Personal Information in accordance with the Privacy Policy may be based in or have servers located outside of Australia, the USA, UK, or EU.
Where we disclose or transfer your Personal Information to third parties overseas, we will take reasonable steps to ensure that data security and appropriate privacy practices are maintained in accordance with the applicable Privacy Obligations.
11. USA-specific provisions
In accordance with the US Privacy Act and California Consumer Privacy Act of 2018, you have the right to:
a. request information about the collection, disclosure, or sale of Personal Information at any time;
b. request deletion of Personal Information at any time; and
c. non-discrimination at all times.
As we do not sell your Personal Information, we do not provide a right to opt-out of the sale of Personal Information.
If you are a resident of California and wish to exercise your rights as set out above, your request must:
a. provide sufficient information to allow us to reasonably verify you are the person about whom we collected Personal Information or an authorised representative thereof; and
b. describe your request with sufficient details to allow us to properly understand, evaluate, and respond.
12. UK-specific provisions
As the controller of your Personal Information, PWR will only use processors that provide sufficient security guarantees, including implementing appropriate technical and organisational measures that ensure compliance with the UK GDPR and protect your rights as the data subject.
In accordance with the UK GDPR, you have the right to:
a. ask us for copies of your Personal Information;
b. ask us to correct or delete Personal Information that you think is inaccurate or incomplete;
c. ask us to delete your Personal Information;
d. ask us to limit how we may use your Personal Information;
e. object to the processing of your Personal Information;
f. ask that we transfer the Personal Information you gave us to another organisation, or to you; and
g. withdraw your consent at any time where it has been provided as the legal basis of our holding Personal Information or Sensitive Information.
13. Monitoring and updates
PWR is accountable for ensuring that Personal Information is managed in accordance with the Privacy Policy and for reviewing the Privacy Policy for compliance with updated legislative requirements.
This Policy was last updated on 22 May 2025.
PWR Group may amend the Privacy Policy from time to time. Any changes to the Privacy Policy will be updated on our website and automatically apply to all of your Personal Information and Sensitive Information. You can obtain a copy of the current Privacy Policy from our website or by contacting us via the details above in Section 4.
14. Complaints and disputes
If you have any complaints regarding how PWR manages your Personal Information or Sensitive Information, please contact the relevant PWR Privacy Officer, contact details of whom are listed in Section 4 above.
It will not always be possible to resolve a complaint to everyone’s satisfaction. If you are not satisfied with PWR’s response to a complaint, you can contact:

· the Information Commissioner’s Office in the UK (www.ico.org.uk/make-a-complaint); or
· the US Department of Justice (www.justice.gov),
for guidance on alternative courses of action that may be available to you.
